SPONSOR: This Contest is sponsored by Iredale Mineral Cosmetics, Ltd. (“Sponsor”) with offices located at 51 Church Street, Great Barrington, Massachusetts 01230.
ELIGIBILITY: This Contest is open to individuals who are (a) members of Pinterest (visit www.pinterest.com for instructions on how to create a free Pinterest account) and (b) legal U.S. residents 18 years of age or older at the time of entry who are physically residing in the 50 United States or the District of Columbia. This Contest is void where prohibited by law and is subject to all applicable federal, state and local laws.
Current and former employees, officers and directors of Sponsor, their agents; affiliates; distributors; sales representatives; retailers; partners; subsidiaries; advertising and promotional agencies; those involved in the production, development, implementation or handling of the Contest and members of their immediate family (spouses, children, siblings, parents and grandparents) and persons living in the same household as such persons are ineligible to enter the Contest or win a prize.
HOW TO ENTER: To enter this Contest, follow @janeiredale on Pinterest (http://pinterest.com/janeiredale), then create a new Pinterest pinboard and name it “jane iredale What Summer Means To Me Contest.” Pin images of what summer means to you on the pinboard. Tag each image in your board with #janeiredalesummer. During the Contest Period (defined below), visit https://www.wf-site.com/microsite/pages/5d66aa0c1653a0ef and follow all on-screen instructions to fill out and submit the entry form provided. All entrants will also need to include on the entry form a URL link to their “jane iredale What Summer Means to Me Contest” board on Pinterest.com. Contestant must complete and submit the entry form, including the link, for the entry to be eligible.
Entry is limited to one pinboard per person. Any attempt by any contestant to obtain more than the stated number of entries by using multiple or different identities or email addresses or by any other method shall void that contestant’s entries, and that contestant may be disqualified in Sponsor’s sole discretion.
No methods of entry other than the method specified herein will be accepted. Entries without complete information and/or not received prior to the end of the Contest Period will not be eligible.
ENTRY GUIDELINES: All submissions must be created by the contestant. Entries must be relevant to the contest topic (“What Summer Means to Me”) and must not contain offensive or obscene material, as determined by Sponsor, in its sole discretion.
CONTEST PERIOD: The Contest begins on June 25, 2013 and all entries must be completed by 11:59 a.m. (Eastern Time) July 22, 2013 (the “Contest Period”).
JUDGING: At the close of the Contest Period, all eligible entries will be judged by Sponsor and five (5) winners will be selected.
WINNER NOTIFICATION: Winning contestants will be notified on or about August 5, 2013 via the email address or other contact information provided by the contestant. Winning contestants will be required to respond (as directed) to the email notification within the time period specified in the notification. The failure to respond timely to the notification may result in forfeiture of the prize; and, in such case, Sponsor may choose another winner from among the remaining eligible Contest entries. The winning contestants may be sent an affidavit of eligibility/liability and publicity release (the “Release”). Each winning contestant will be required to complete and return the Release within the time period specified therein. Winning contestants shall allow Sponsor to use their name, likeness, voice and/or biographical data for marketing purposes without limitation and without additional notice, compensation, or consent. Winning contestants may also be required to provide their name, birth date, current address and phone number. As a condition of receiving a prize, winning contestants shall grant the license to use the submission described in “Use of Winning Submissions” below. Should a winning contestant be unwilling or otherwise unable to enter into such license, or provide such permissions and/or releases or otherwise cannot accept or receive the prize for any reason, an alternate contestant will be selected by Sponsor from the remaining eligible entries until one who is able to meet all requirements shall be selected. Winning contestants must provide Sponsor with the signed Release and return all documents in a timely manner as required pursuant to these Official Rules in order to be eligible to receive any prize. PRIZES: Each winner will receive a prizepackage that will include one each of the following jane iredale products: Powder-Me SPF 30 Dry Sunscreen; Smooth Affair Facial Primer; POMMISST Hydration Spray; SO-Bronze 3; Tantasia Self Tanner & Bronzer; Lip Drink SPF 15 Lip Balm; Forever Pink Lip & Cheek Stain; Dot the i Makeup Remover; Blotting Papers. The average retail value of each package is $249.
Odds of winning depend on number of entries received. Prizes are limited to those listed in these Official Rules. Winning contestants are not entitled to any surplus between actual value of prize and stated retail value. In the event Sponsor is unable to award a prize as stated, the winning contestant will receive a substitute prize of equal or greater value, at Sponsor’s discretion. Any costs or fees not specifically listed herein, as well as any applicable federal, state and local taxes, are the responsibility of the winning contestant. Winning contestants may expect delivery of prize within 6 weeks of prize notification, unless otherwise noted at the time of prize notification.
USE OF WINNING SUBMISSIONS: Provided that a winning contestant accepts contestant’s prize, Sponsor shall have the right to use such contestant’s winning submission in merchandising, advertising, marketing or promotion or for any other commercial or non-commercial purpose without additional compensation to the contestant. As a condition to receiving a prize, each winning contestant shall grant to Sponsor, for no additional compensation, a non-exclusive, sub-licensable, royalty-free, fully paid license and right to use, distribute, make derivative works from and otherwise exploit the submission, in any manner and in any medium now known or hereafter devised, throughout the world in perpetuity. Contestants hereby forever waive and relinquish all so-called "moral rights (droit moral)" now or hereafter recognized.
USE OF ALL SUBMISSIONS: Sponsor shall have the right to use all submissions for the purposes of promoting the Contest and other contests administered by Sponsor without additional compensation, and contestant, by making such submission, grants Sponsor a perpetual, non-exclusive, sub-licensable, royalty-free, fully-paid license and right to use, distribute the submission for those promotional purposes.
TERMS AND CONDITIONS: The Contest is subject to these Official Rules and by participation in the Contest, contestants agree to be bound thereby. This Contest is in no way sponsored, endorsed or administered by, or associated with Pinterest or Facebook. All information provided by contestants in connection with the Contest is being provided to Sponsor and not to Pinterest or Facebook. By entering the Contest, contestants agree to release and hold harmless Sponsor, Pinterest, Inc., Facebook Inc., and their respective parent companies, subsidiaries, affiliates, advertising/promotion agencies, and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
All decisions of the Sponsor are final and binding and contestants agree to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law.
Sponsor is not responsible for: (a) lost, late, misdirected, undeliverable, incomplete or indecipherable submissions due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or entries; (b) technical failures of any kind; (c) failures of any of the equipment or programming associated with or utilized in the Contest; (d) unauthorized human and/or mechanical intervention in any part of the submission process or the Contest; (e) technical or human error which may occur in the administration of the Contest or the processing of entries; (f) any printing, typographical, administrative or technological errors in any materials associated with the Contest; or (g) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from any contestant’s participation in the Contest or receipt or use of any prize.
Sponsor reserves the right to disqualify any contestant it finds to be violating these Official Rules. Sponsor reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 5submissions, or due to circumstances beyond its control, including natural disasters. Sponsor has the right, but not the obligation, to use any winning submission. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Contest and reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit a contestant from participating in the Contest or winning a prize if, in its sole discretion, it determines such contestant is attempting to undermine the legitimate operation of the Contest by cheating, plagiarizing, engaging in any deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other contestants or Sponsor representatives. Disputes regarding these Official Rules and/or this Contest will be governed by the laws of the Commonwealth of Massachusetts, without giving effect to the conflicts or choice of law provisions of Massachusetts or any other jurisdiction. Contestants agree to submit to the jurisdiction of the state or federal courts of Massachusetts, with venue in Berkshire County with respect to any state court proceeding, and Springfield, Massachusetts, with respect to any federal court proceeding in connection with any and all legal actions or claims arising in connection with the Contest.
